1.4 Children

The Services are intended for individuals who are at least eighteen (18) years of age. We do not knowingly collect personal information from children under eighteen. If we learn that we have collected personal information from a child under eighteen, we will delete it.

3. HOW WE SHARE INFORMATION

We share personal information only in the circumstances described in this Section.

3.1 Service Providers

We share personal information with vendors that help us operate the Services, including hosting providers, customer relationship management (CRM) platforms, email delivery providers, SMS delivery providers and aggregators (for example, Twilio), payment processors, analytics providers, advertising platforms, and customer support tools. These providers are contractually required to use personal information only to provide their services to us and to protect the information consistent with this Policy and applicable law.

3.2 Legal and Safety

4. SMS PROGRAM DISCLOSURE

This Section 4 applies specifically to information we collect and use in connection with the YBM Agency SMS text-messaging program (the "SMS Program"). It is provided to satisfy carrier and industry-standard disclosure requirements applicable to application-to-person (A2P) messaging in the United States.

4.1 Program Description and Categories of Data

The SMS Program is operated by YBM Agency. Through the SMS Program, we send transactional, informational, and marketing SMS/MMS messages to individuals who have expressly opted in. In connection with the SMS Program, we collect and process:

  • the mobile telephone number you provide when opting in;
  • your name and any other identifying information you provide on the opt-in form;
  • the fact that, the date and time when, and the method by which, you provided your consent to receive SMS messages ("opt-in data");
  • records of the messages we send to you and any replies we receive (including opt-out and help requests);
  • information necessary to route, deliver, and troubleshoot messages, including carrier and delivery status information.

4.2 Consent

You will only receive SMS messages from YBM Agency if you have expressly opted in. Opt-in is obtained by checking the dedicated SMS consent checkbox on our Website (or another opt-in surface we operate) and submitting your mobile telephone number. Your consent to receive SMS messages is not required as a condition of purchasing any goods or services from us. Consent is granted per mobile telephone number and only for the number you provide.

4.3 Message Frequency

Message frequency varies based on your engagement with us and the topics for which you opted in.

4.4 Message and Data Rates

Message and data rates may apply. YBM Agency does not charge for the SMS Program itself, but your wireless carrier's standard message and data rates apply to each message sent and received. Contact your wireless provider for information about your text or data plan.

4.5 Opt-Out (STOP)

You can opt out of the SMS Program at any time by replying STOP to any message you receive from us. After you send STOP, you will receive a single confirmation message acknowledging your opt-out, and no further SMS messages will be sent to you through that program. You may re-subscribe at any time by opting in again.

4.6 Help (HELP)

4.7 Supported Carriers and Delivery

The SMS Program is available on most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Message delivery depends on the effective transmission from your wireless service provider and is outside YBM Agency's control.

4.8 No Sharing of Mobile Opt-In Data with Third Parties for Marketing

NO MOBILE INFORMATION WILL BE SHARED WITH THIRD PARTIES OR AFFILIATES FOR MARKETING OR PROMOTIONAL PURPOSES. Information sharing with subcontractors that support the operation of the SMS Program (such as SMS delivery aggregators and customer support providers) is permitted solely for that purpose. All categories of data described in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4.9 Use of SMS Information

Information collected in connection with the SMS Program is used solely to operate and administer the SMS Program: to deliver messages, honor opt-in and opt-out requests, respond to your inquiries, comply with applicable law and carrier requirements, maintain records required for compliance and audit purposes, and troubleshoot delivery issues. We do not use SMS opt-in data for advertising, retargeting, or sale to third parties.

4.10 Retention

We retain SMS opt-in data and message records for as long as is necessary to operate the SMS Program, to demonstrate compliance with applicable law and carrier requirements, and to enforce our agreements. When retention is no longer required, we delete or de-identify the information.

5. LEGAL BASES FOR PROCESSING (EEA AND UK USERS)

If you are located in the European Economic Area or the United Kingdom, our legal bases for processing your personal information include: (a) your consent (for example, for marketing communications and the SMS Program); (b) the performance of a contract with you or steps taken at your request prior to entering into a contract; (c) compliance with a legal obligation; and (d) our legitimate interests in operating and improving our business, provided those interests are not overridden by your rights.

6. INTERNATIONAL DATA TRANSFERS

YBM Agency is based in the United States, and the personal information we collect is processed in the United States and in other countries where our service providers operate. If you are located outside the United States, please be aware that laws in the United States may differ from those of your home country.
